Healthcare workers who are on the front line of coronavirus disease 2019 and are also undergoing shift schedules face long work hours with few pauses, experience desynchronization of their circadian rhythm, and an imbalance between work hours effort and reward in saving lives, resulting in an impact on work capacity, aggravated by the lack of personal protective equipment, few resources and precarious infrastructure, and fear of contracting the virus and contaminating family members. Some consequences are sleep deprivation, chronic insomnia, stress-related (...) sleep disorders, and post-traumatic stress disorder. These sleep alterations critically affect mental health, precipitating or perpetuating anxiety, stress, and depression, resulting in the inability to regulate positive and negative emotions. Pre-existing sleep disorders are an important risk factor for the development and maintenance of PSTD when individuals are exposed to an important stressor such as a COVID-19 pandemic. At the same time, how an individual regulates the emotion associated with worries during daytime functioning impacts nighttime sleep, precipitating and perpetuating difficulties in sleeping. All of these changes in sleep and emotional regulation also alter the immune system. Sleep deprivation is commonly associated with chronic inflammatory diseases, due to the desynchronizations in circadian rhythms, causing possible psychophysiological disorders and impaired neuroimmune-endocrine homeostasis. From this perspective, we clarify in this article how sleep disorders affect the immune system and emotional regulation, explaining their phenomenological and neurobiological mechanisms, and discussing elements of cognitive and behavioral coping for health professionals to adopt and manage a healthier sleep pattern in the COVID-19 outbreak. This paper offers some insights and clarifications of the paramount role that Mexico has had in the forging of first-order cybernetics. Our account starts with Arturo Rosenblueth as a key intellectual figure in the foundation and formation of the field. After revisiting a historical context of people and places, we proceed to a cultural and media archeological investigation that helps us obtain new insights into the ongoing effort to intertwine the complex intellectual networks across different countries in Latin America, North (...) America, and Europe. We then present cases and first-hand interviews to discuss the legacy of cybernetics in Mexico around institutions where Rosenblueth was affiliated, mainly the Institute of Cardiology and, later on, the CINVESTAV at the Instituto Politécnico Nacional. We claim that subjective affinities are as important as common scientific goals to establish and keep connections alive, necessary to the development of a research field. As the active compound in spicy peppers, capsaicin represents a local component to the definition of cybernetics. Ultimately, the paper aims to contribute to the research on the importance of cybernetics in Latin America. (shrink)

Se argumenta que antes de (...) la llegada europea hubo una etapa fuertemente influida por las relaciones con Asia. Éstas continuaron aún en época colonial, en términos comerciales, demográficos y artísticos, junto a una fuerte inmigración e influencia cultural africana. Si bien la independencia supuso una serie de ilusiones sobre el fomento de las relaciones con Asia, el siglo xix fue de creciente influencia europea (demográfica, militar, política, económica, cultural). The objective of this work is to establish a relationship between the cutting time in rocks, determining a speed and the point load strength index test, Is, to characterize the rock in terms of resistance and avoid sending samples to laboratories. As a first stage, on andesite samples, 5 x 5 x 10 cm test tubes were made. After the elaboration they were subjected to cutting, using an electric floor cutter and the time was evaluated. This cut was made in (...) a transversal way and two parts were obtained, one of them with dimensions 5 x 5 x 5 cm, approximately. In a third stage, the point load strength test was carried out in a press built for this purpose. Finally, the cutting speeds were correlated with the point load test values and only when rock samples do not pigeonhole on the proposed relationship, send them to the laboratory. These thirteen paragraphs portray epistemology as the study, not directly of knowing as a human action (which could be considered the object also of anthropology) but as the study of the mode of being of the object in the subject and, in this sense, of intentional being. Moreover, intentional being is not understood as the being of the cognitional species or representation, which is real and subjective, but as the being of the known, as the presence of the known to (...) the knower (obviously, through the species but a being not reduced to the subjective being of the species): this kind of being is the proper object of epistemology. Other considerations regarding the distinction between metaphysics and epistemology take place as well. As regards the method, this essay attempts to apply Aquinas’ four steps of scientific reasoning to epistemology, in the following fashion and order: 1- Solution of the problem of the universals by recourse to the theory of the agent intellect (resolutio secundum rem); 2- Definition of knowledge as intentional possession of being (res. sec. rationem); 3- Judgment of value regarding the different instances of human knowledge or critique of knowledge (compositio secundum rem) and 4- Reinterpretation (in the light of the previous path) of common notions of epistemology, such as truth, certainty, evidence, and error (comp. sec. rationem). Plagiarism is a serious, yet widespread type of research misconduct, and is often neglected in developing countries. Despite its far-reaching implications, plagiarism is poorly acknowledged and discussed in the academic setting, and insufficient evidence exists in Latin America and developing countries to inform the development of preventive strategies. In this context, we present a longitudinal case study of seven instances of plagiarism and cheating arising in four consecutive classes of an Epidemiology Masters program in Lima, Peru, and describes the implementation (...) and outcomes of a multifaceted, “zero-tolerance” policy aimed at introducing research integrity. Two cases involved cheating in graded assignments, and five cases correspond to plagiarism in the thesis protocol. Cases revealed poor awareness of high tolerance to plagiarism, poor academic performance, and widespread writing deficiencies, compensated with patchwriting and copy-pasting. Depending on the events’ severity, penalties included course failure and separation from the program. Students at fault did not engage in further plagiarism. Between 2011 and 2013, the Masters program sequentially introduced a preventive policy consisting of: intensified research integrity and scientific writing education, a stepwise, cumulative writing process; honor codes; active search for plagiarism in all academic products; and a “zero-tolerance” policy in response to documented cases. No cases were detected in 2014. In conclusion, plagiarism seems to be widespread in resource-limited settings and a greater response with educational and zero-tolerance components is needed to prevent it. (shrink)

In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

Value is an inescapable part of the human experience and what life must be like for a conscious and feeling person. Philosophical questions about value are therefore naturally invited: What sort of thing would value be if it were part of the furniture of the world? How should we understand the relations that value is thought to stand in to other things? In a broad sense, these are formal questions calling for philosophical studies into the understanding of value notions. The (...) following work represents one such study. Some versions of moral naturalism are faulted for implausibly denying that moral obligations and prescriptions entail categorical reasons for action. Categorical reasons for action are normative reasons that exist and apply to agents independently of whatever desires they have. I argue that several defenses of moral naturalism against this charge are unsuccessful. To be a tenable meta-ethical theory, moral naturalism must accommodate the proposition that, necessarily, if anyone morally ought to do something, then s/he has a categorical reason to do (...) it. Versions of moral naturalism that deny this claim would, if widely believed, disable some crucial practical uses of moral concepts. In particular, if the existence of normative reasons for action is taken to be dependent on agents’ desires, it would breed profound skepticism about the legitimacy of evaluating others’ actions from a moral point of view. Also, it would raise doubts about whether people ought to correct their own behavior in light of moral considerations. Following Richard Joyce, I take these consequences to indicate that the concept of a categorical reason is a “non-negotiable” part of moral concepts. (shrink)

Since it implies a reduction in the quality and the quantity of the natural resources, environmental degradation is a present day problem that requires immediate solutions. This situation is driving firms to undertake an environmental transformation process with the purpose of reducing the negative externalities that come from their economic activities. Within this context, environmental marketing is an emerging business philosophy by which organizations can address sustainability issues. Moreover, environmental marketing and orientation are seen as valuable strategies to improve a (...) firm's competitiveness. However, the literature that has analyzed the link between environmental strategies and firms' results has been inconclusive and contradictory. In this study, we propose and test a model that analyses how the implementation of ecological issues within a firm's marketing strategy and orientation influences organizational results. Data were obtained through a survey sent to Spanish manufacturing firms. The results show that environmental marketing positively affects firms' operational and commercial performance and this improvement will influence their economic results. Moreover, environmental marketing is revealed as an excellent strategy to obtain competitive advantages in costs and in product differentiation. Thus, this study agrees with the researchers who affirm that environmental strategies positively affect firm's competitiveness while reducing environmental impact. (shrink)

El imaginario de superioridad expresado a lo largo de tres siglos de colonia perdura pasados dos siglos de independencia de las naciones americanas en el ideario religioso y cultural. La idea de la superioridad de la religión católica o la protestante, cristiana en definitiva, gestado desde los preludios de una temprana modernidad por los conquistadores occidentales y refrendada por filósofos modernos de tendencia protestante como Hegel (en sus Lecciones sobre filosofía de la religión o en la Enciclopedia de las ciencias (...) filosóficas) dejaron espinosos rasgos poscoloniales que perduran arraigados en los horizontes de comprensión de la actividad filosófica y cultural hispanoamericana, latinoamericana, europea y americana en general; mucho más cuando estos rasgos de superioridad cultural permanecen, inclusive, en algunos críticos de la religión y de occidente como en su momento lo fueron Marx y Engels (en Materiales para la historia de América Latina se recopilan sus pensamientos dispersos a propósito de América). El tema es complejo, quienes con antelación han criticado las concepciones de culturas superiores son numerosos y de antaño, algunos de estos críticos lo son desde la perspectiva decolonial otros desde de estudios subalternos y otros más desde el ámbito filosófico. St. Thomas Aquinas has always considered intelligence a potency higher than the will, absolutely speaking. That being said, and in my view, the existential primacy of the will in the act of freedom (particularly in choosing the existential end) is also indisputably Thomistic, as Cornelio Fabro has shown. This paper endeavors to explain Aquinas' doctrine on the absolute primacy of the intellect and thus show that these two primacies can be affirmed coherently, that is, the intellect’s absolute primacy and the (...) will’s existential primacy. Firstly, I will explain the reasoning St. Thomas Aquinas uses in the Summa to justify the absolute primacy of the intellect over the will. Secondly, I will explore some parallel texts, in order to shed light on my interpretation of the Summa and expand our view regarding this and related doctrinal points. Thirdly, I will offer a brief study of Fabro’s position, one in which his concerns regarding the intellect’s absolute primacy are taken into account and carefully considered. (shrink)

In this essay, I deal with the problem of the attribution of psychological predicates to non-human animals. The first section illustrates three research topics where it has become scientifically legitimate to explain the conduct of non-human animals by means of the attribution of psychological predicates. The second section discusses several philosophical objections to the legitimacy of such attributions provided by central thinkers from the last decades. I try to show that these objections —which are related among other questions to the (...) holism of the mental, the indeterminacy of the attributions, and the strangeness of animal concepts— can be alleviated. In the third section, I propose to adopt a literalist view of the attributions in the sense articulated by Figdor. At the same time, I argue that one must draw limits to the conceptual change forwarded by her literalist view, taking into account holistic considerations and the fact that the psychological concepts must retain their core notes. In a recent paper, Erasmus et al. (2021) defend the idea that the ambiguity of the term “explanation” in explainable AI (XAI) can be solved by adopting any of four different extant accounts of explanation in the philosophy of science: the Deductive Nomological, Inductive Statistical, Causal Mechanical, and New Mechanist models. In this chapter, I show that the authors’ claim that these accounts can be applied to deep neural networks as they would to any natural phenomenon is mistaken. I also (...) provide a more general argument as to why the notion of explainability as it is currently used in the XAI literature bears little resemblance to the traditional concept of scientific explanation. It would be more fruitful to use the label “understandable AI” to avoid the confusion that surrounds the goal and purposes of XAI. In the second half of the chapter, I argue for a pragmatic conception of understanding that is better suited to play the central role attributed to explanation in XAI. Following De Regt (2017) and Kuorikoski and Ylikoski (2015), the conditions of satisfaction for understanding an ML system are fleshed out in terms of an agent’s success in using the system. As society advances, the educational system remains linked to the traditional model focused on the transmission of information and must adapt to new times and new profile of students, with the students and learning centered education. Active pedagogies developed during the 20th century become a fundamental reference point for the implementation of education competencies.

In this article I criticize Hannah Arendt's concept of natality as unable to confront the ways in which racial capitalism links the biopolitical cultivation of natality to the necropolitical natal alienation that is structural to modern slavery. I base this argument in an understanding of social death as the production of racial capitalism, one that gives slavery an aftermath, post-abolition, which continues to dispossess Black and brown people of their capacity to begin something anew via their inclusion into juridical personhood. I conclude this article with an articulation of the political impossibility of Black and brown people to begin something anew under a polis that remains structured by racial capitalism in Ralph Ellison's phenomenological description of the invisible man's misrecognized new beginnings with the Brotherhood. The Militant Intellect reconceptualizes critical theory as a field tasked with cultivating the analytical skills of the general intellect to work towards the intersectional and structural death of the colonist and the materialization of that feminist decolonial communist queer marronage world that constitutes its horizon.

Twenty years ago John Worrall offered an alleged non-standard viable form of scientific realism under the name structural realism. Structural realism was supposed to be both an alternative to standard scientific realism and a viable form of realism. The central questions addressed in this paper are what I call the two dogmas of structural realism: the idea that there is structure retention across theory change, and the idea that theoretical structures describe the world. Arthur Fine proclaimed that scientific realism was (...) dead. I claim that Worrall's attempt to bring scientific realism back to life has failed. John Worrall ofreció hace veinte años una forma no típica, supuestamente viable, de realismo científico a la que llamó realismo estructural. Se suponía que éste era una alternativa al realismo típico y una forma viable de realismo. Las cuestiones principales que discuto en este artículo son lo que denomino los dos dogmas del realismo estructural: la idea de que hay retención de estructura en el cambio teórico, y la idea de que las estructuras teóricas describen el mundo. Philosophers have applied the framework of constitutive grounds to make sense of the disagreement between subjectivism and objectivism. The framework understands the two theories as being involved in a disagreement about the extent to which value is determined by attitudes. Although the framework affords us with some useful observations about how this should be interpreted, the question how value can be determined by attitudes in the first place is left largely unanswered. Here we explore the benefits of a positive interpretation (...) which aims to address this oversight and make the framework more informative. This interpretation, which is inspired by the recent work of Schroeder and Sobel, claims that the relevant sense in which value can be determined by attitudes is discovered by seeing how facts can be endowed with the normative property of being a reason. We argue that this interpretation significantly deepens our understanding of the disagreement between subjectivism and objectivism. (shrink)

This paper analyzes the impact that Lamarckian evolutionary theory had in the scientific community during the period between the advent of Zoological Philosophy and the publication Origin of Species. During these 50 years Lamarck’s model was a well known theory and it was discussed by the scientific community as a hypothesis to explain the changing nature of the fossil record throughout the history of Earth. Lamarck’s transmutation theory established the foundation of an evolutionary model introducing a new way to research (...) in nature. Darwin’s selectionist theory was proposed in 1859 to explain the origin of species within this epistemological process. In this context, Charles Lyell’s Principles of Geology and Auguste Comte’s Cours de Philosophie Positive appear as two major works for the dissemination of Lamarck’s evolutionary ideology after the death of the French naturalist in 1829. This paper is an attempt to clarify, from a Thomistic point of view, the nature and method of metaphysics. I argue that metaphysics' object is created being, not God, even if God enters metaphysics as efficient cause of metaphysic's object. Also, that metaphysics is a science, insofar as a particular kind of coherent reasoning process, going from the many to understand a certain oneness, and then from that oneness to reinterpret the many. Moreover, that, in this particular process of reasoning, (...) doctrinal topics must follow a certain order. Thus, in particular, I argue that the distinction between essence and act of being in every creature cannot be argued before arguing the existence of God. In this paper I critically examine the notion of explanation used in Artificial Intelligence in general, and in the theory of belief revision in particular. I focus on two of the best known accounts in the literature: Pagnucco’s abductive expansion functions and Gärdenfors’ counterfactual analysis. I argue that both accounts are at odds with the way in which this notion has historically been understood in philosophy. They are also at odds with the explanatory strategies used in actual scientific practice. Durante los últimos años, el problema de cómo justificar aquellas creencias que se originan en testimonios ha ocupado un lugar central en la epistemología. Sin embargo, muy pocas de esas reflexiones son conocidas en el derecho probatorio. En el presente ensayo analizo la prueba testimonial a la luz de estas reflexiones con el fin de poner de manifiesto los supuestos epistemológicos de algunos principios procesales. En concreto, analizo la legislación colombiana y la estadounidense en el marco de la disputa entre (...) el reduccionismo y el antirreduccionismo en la filosofía del testimonio. Al final sugiero una nueva aproximación epistemológica que replantea los términos de la disputa y que tiene implicaciones importantes para la valoración de la prueba testimonial en los procesos judiciales. We study notions of independence appropriate for a stability theory of metric abstract elementary classes (for short, MAECs). We build on previous notions used in the discrete case, and adapt definitions to the metric case. In particular, we study notions that behave well under superstability‐like assumptions. Also, under uniqueness of limit models, we study domination, orthogonality and parallelism of Galois types in MAECs.

This volume contains the proceedings of the Logic at Harvard conference in honor of W. Hugh Woodin's 60th birthday, held March 27–29, 2015, at Harvard University. It presents a collection of papers related to the work of Woodin, who has been one of the leading figures in set theory since the early 1980s. The topics cover many of the areas central to Woodin's work, including large cardinals, determinacy, descriptive set theory and the continuum problem, as well as connections between set (...) theory and Banach spaces, recursion theory, and philosophy, each reflecting a period of Woodin's career. Other topics covered are forcing axioms, inner model theory, the partition calculus, and the theory of ultrafilters. This volume should make a suitable introduction to Woodin's work and the concerns which motivate it. The papers should be of interest to graduate students and researchers in both mathematics and philosophy of mathematics, particularly in set theory, foundations and related areas. (shrink)

Education is a fundamental pillar in human development, and its evolution throughout history has been influenced by a variety of factors, including imaginative culture and human nature. In this study, we explore how educational methods have evolved in response to the interaction between these two aspects. We look at how human creativity, imagination, and adaptation have influenced the way we teach and learn, from early forms of knowledge transmission to more contemporary approaches focused on active student engagement and the development (...) of practical skills. Our research is based on a comprehensive review of the academic literature in the fields of education, evolutionary psychology, cultural anthropology, and imagination studies. We explore how societies have used imagination as a tool to transmit knowledge and values, as well as to foster creativity and individual expression. We also examine how adaptive aspects of human nature, such as the ability to learn collaboratively and adapt to changing environments, have influenced the way educational methods are designed. Our results show a clear evolution in educational methods over time, from approaches focused on the one-way transmission of knowledge to more interactive and participatory models that encourage exploration and discovery. We identify common patterns in the way societies have used imagination and adaptation to promote learning and socialization and discuss the implications of these findings for contemporary education. In conclusion, this study highlights the importance of understanding the relationship between imaginative culture, human nature, and education. It provides a solid foundation for the design of educational methods that harness the innate creativity and adaptability of human beings and offers guidance for educators and policymakers on how to promote meaningful and lasting learning in today's world. Since it implies a reduction in the quality and the quantity of the natural resources, environmental degradation is a present day problem that requires immediate solutions. This situation is driving firms to undertake an environmental transformation process with the purpose of reducing the negative externalities that come from their economic activities. Within this context, environmental marketing is an emerging business philosophy by which organizations can address sustainability issues. Moreover, environmental marketing and orientation are seen as valuable strategies to improve a (...) firm's competitiveness. However, the literature that has analyzed the link between environmental strategies and firms' results has been inconclusive and contradictory. In this study, we propose and test a model that analyses how the implementation of ecological issues within a firm's marketing strategy and orientation influences organizational results. Data were obtained through a survey sent to Spanish manufacturing firms. The results show that environmental marketing positively affects firms' operational and commercial performance and this improvement will influence their economic results. Moreover, environmental marketing is revealed as an excellent strategy to obtain competitive advantages in costs and in product differentiation. Thus, this study agrees with the researchers who affirm that environmental strategies positively affect firm's competitiveness while reducing environmental impact. (shrink)

This paper critically examines the forays into metaphysics of The Dual Nature of Technical Artifacts Program (henceforth, DNP). I argue that the work of DNP is a valuable contribution to the epistemology of certain aspects of artifact design and use, but that it fails to advance a persuasive metaphysic. A central problem is that DNP approaches ontology from within a functionalist framework that is mainly concerned with ascriptions and justified beliefs. Thus, the materiality of artifacts emerges only as the external (...) conditions of realizability of function ascription. The work of DNP has a strong programmatic aspect and much of its foray into metaphysics is tentative, so the intent of my argument is partly synthetic: to sum up these issues as they are presented in the literature and highlight some recognized problems. But I also go beyond that, suggesting that these problems are foundational, arising from the very way in which DNP poses the question of artifact metaphysics. Although it sets out to incorporate objective aspects of technology, DNP places a strong focus on the intentional side of the purported matter-mind duality, bracketing off materiality in an irretrievable manner. Thus, some of the advantages of dualism are lost. I claim that DNP is dualistic, not merely based on “duality”, but that its version of dualism does not appropriately account for the material “nature” of artifacts. The paper ends by suggesting some correctives and alternatives to Dual Nature theory. (shrink)

Cada día es más evidente que existen muchas formas sutiles de exclusión y parcialidad que afectan el correcto funcionamiento de los sistemas jurídicos. El concepto de injusticia epistémica, introducido por la filósofa Miranda Fricker, ofrece una herramienta conceptual útil para comprender estas formas de exclusión y parcialidad judicial que a menudo pasan desapercibidas. En este artículo presentamos la teoría original de Fricker y algunas de las aplicaciones del concepto de injusticia epistémica en los procesos jurídicos. En particular, queremos demostrar que (...) la semilla sembrada por Fricker ha generado un floreciente campo de estudio en el cual el concepto se utiliza para analizar muchos fenómenos diferentes en el ámbito jurídico, no siempre siguiendo la caracterización original proporcionada por ella. Esto ha llevado a una distinción entre lo que llamaremos la versión estrecha del concepto, que se acerca a la descripción original de Fricker, y la versión más amplia de injusticia epistémica, que es una noción más controvertida porque existe el riesgo de que se confunda con otros conceptos más conocidos como el sexismo, la discriminación racial, la opresión, el silenciamiento y el gaslighting. Mostraremos que el valor de la versión estrecha es principalmente teórico y que para utilizar el concepto de injusticia epistémica se debe adoptar una comprensión más liberal del mismo. (shrink)

Moral Seduction Theory suggests that auditors are morally compromised by the perceived consequences of their opinions. The root of the auditing problem appears to result in an unintentional bias rather than in dishonesty. Although important accounting reforms have been taken to deal with auditors' trustworthiness, their lack of independence has not been adequately addressed. The new regulation (Sarbanes-Oxley Act) is a consequence of an incorrect understanding of the main true source of auditor's biases. We have developed a cognitive approach by (...) connecting the Throughput Model (TM) to the Moral Seduction Theory. This approach allows a better understanding of how conflicts of interest lead auditors to avoid the issuance of warning signals to stakeholders. We have tested our model by conducting a hypothetical scenario with eighty experienced auditors from international accounting firms. Our results confirm auditors' unintentional reluctance to issue qualified audit opinions alerting investors due to their fear of precipitating clients' final bankruptcy. The main implication is that, more than a regulation, effort should be made in monitoring those conflicts of interest to reduce unintentional bias. (shrink)

Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. In Lukács: Praxis and the Absolute, Daniel Andrés López reassembles Lukács’s philosophy of praxis on a Hegelian basis, as a conceptual-historical totality, both defending him and proposing an unprecedented, immanent critique that raises problems for Marxian philosophy as a whole.

The origin of paraconsistent logic is closely related with the argument, ‘from the assertion of two mutually contradictory statements any other statement can be deduced’; this can be referred to as ex contradictione sequitur quodlibet (ECSQ). Despite its medieval origin, only by the 1930s did it become the main reason for the unfeasibility of having contradictions in a deductive system. The purpose of this article is to study what happened earlier: from Principia Mathematica to that time, when it became well (...) established. The two main historical claims that I am going to advance are the following: (1) the first explicit use of ECSQ as the main argument for supporting the necessity of excluding any contradiction from deductive systems is to be found in the first edition of the book Grundzüge der Theoretischen Logik (Hilbert, D. and Ackermann, W. 1928. Grundzüge der Theoretischen Logik. Berlin: Julius Springer Verlag); (2) Łukasiewicz's position regarding the logical constraints against contradictions varies considerably from his studies on the principle of (non-) contradiction in Aristotle, published in 1910 and what is stated in his `authorized lectured notes' on mathematical logic that appeared in 1929. The two texts are: 1) a paper in German (Łukasiewicz, J. 1910. `Über den Satz des Widerspruchs bei Aristotles'. Bulletin International de l'Académie des sciences de Cracovie, Classe d'Histoire et de Philosophie, pp. 15–38) [English translation: Łukasiewicz, J. 1971. ‘On the principle of contradiction in Aristotle’, Review of Metaphysics, XXIV, 485–509]; and 2) a book in Polish. Łukasiewicz, J. 1910. O zasadzie sprzecznosci u Aristotelesa Studium krytyczne, Warsaw: Panstwowe Wydawnictwo Naukowe [German translation: Łukasiewicz, J. 1993. Über den Satz des Widerspruchs bei Aristotles. Hildesheim: Georg Olms Verlag]. The lecture notes were then published as a book (Łukasiewicz, J. 1958. Elementy Logiki Matematycznej. Warszawa: Panstwowe Wydawnictwo Naukowe [PWN] and then translated into English (Łukasiewicz, J. 1963. Elements of Mathematical Logic. Oxford, New York: Pergamon Press/the Macmillan Company). The second half of this article will concentrate on Łukasiewicz's position on ECSQ. This will lead me to propose that to regard him as a forerunner of paraconsistent logic by virtue of those early writings is accurate only if his book published in Polish is considered but not if the analysis is restricted to the paper originally published in German (as has been the case for the principal reconstructions of the history of paraconsistent logic). Furthermore, I will stress that in the 1929 book he presented one formalization of ECSQ as an axiom for sentential calculus and, also, he used ECSQ to defend the necessity of consistency, apparently independently of Hilbert and Ackermann's book. At the end, I will suggest that the aim of twentieth century usage of ECSQ was to change from the centuries-long philosophical discussion about contradictions to a more ‘technical’ one. But with paraconsistent logic viewed as a technical solution to this restriction, then, the philosophical problem revives but having now at one's disposal an improved understanding of it. Finally, Łukasiewicz's two different positions about ECSQ open an interesting question about the history of paraconsistent logic: do we have to attempt a consistent reconstruction of it, or are we prepared to admit inconsistencies within it?
